Terms of Service for QRner.ai

These Terms of Service ("Terms") govern your access to and use of the QRner.ai platform (the "Platform"), including all services and features offered by QRner.ai, such as the QR Maker, Bio Page Builder, File Hosting, and AI-powered URL Shortener. By accessing or using QRner.ai, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our Platform.

1. Acceptance of Terms

By using QRner.ai (the "Service"), you agree to comply with these Terms of Service and any other rules, policies, or guidelines that we may establish from time to time. QRner.ai reserves the right to update or modify these Terms at any time. Any changes to these Terms will be posted on this page, and your continued use of the Platform after such changes constitutes your acceptance of the updated Terms.

2. Eligibility

To use the Platform, you must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater. If you are under 18, you may use the Platform only with the involvement of a parent or legal guardian.

3. User Registration

To use certain features of the Platform, you may be required to create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, you must immediately notify us.

4. Use of the Platform

You may use QRner.ai and its features for lawful purposes only. You agree to comply with all applicable laws and regulations while using the Platform. You may not:

  • Engage in any activity that disrupts or interferes with the functionality of the Platform.

  • Use the Platform for any illegal or fraudulent activity, including phishing, spamming, or distributing malware.

  • Infringe on the intellectual property rights of others.

  • Attempt to gain unauthorized access to the Platform, other users' accounts, or our computer systems.

5. Intellectual Property

The content, features, and functionality of QRner.ai, including but not limited to logos, designs, text, images, graphics, and software, are owned by or licensed to QRner.ai and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any content without explicit written permission from QRner.ai.

By uploading content (such as QR codes, bio pages, and files) to the Platform, you grant QRner.ai a worldwide, non-exclusive, royalty-free license to use, store, and display such content in accordance with our Privacy Policy.

6. User Content

You retain ownership of the content you upload to QRner.ai, but you grant us a license to store, display, and process your content for the purpose of providing our services. You are solely responsible for any content you upload, and by doing so, you represent and warrant that you have all necessary rights and permissions to use and share such content.

QRner.ai has the right to remove or suspend access to any content that violates these Terms, our Privacy Policy, or any applicable laws or regulations.

7. Prohibited Uses

In addition to the restrictions set forth above, you agree not to use the Platform for any of the following prohibited activities:

  • Uploading, transmitting, or storing content that is obscene, offensive, defamatory, or violates the rights of others.

  • Using the Platform in a way that could damage, disable, or impair QRner.ai’s services or interfere with others' use of the Platform.

  • Engaging in any activity that may compromise the security or integrity of QRner.ai’s services or systems.

8. Third-Party Services

QRner.ai may integrate with third-party services, such as payment processors, analytics providers, or advertising networks. Your use of these third-party services is subject to their respective terms of service and privacy policies. QRner.ai is not responsible for any third-party services or content.

9. Payment and Subscription

Certain features of QRner.ai are offered on a paid subscription basis. If you choose to subscribe to a paid plan, you agree to pay all applicable fees. Payment is processed through a third-party provider, and you are responsible for ensuring that your payment information is accurate and up to date.

Subscription fees are non-refundable, and we reserve the right to change pricing at any time with prior notice. In the event of a subscription cancellation, you will continue to have access to the paid features until the end of the billing cycle.

10. Termination

QRner.ai reserves the right to suspend or terminate your account and access to the Platform at our sole discretion, with or without notice, if you violate these Terms or engage in behavior that we deem harmful or inappropriate. Upon termination, your right to use the Platform will cease, and we may delete your account and any associated data.

11. Disclaimer of Warranties

QRner.ai provides the Platform on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, regarding the availability, accuracy, reliability, or fitness for a particular purpose of the Platform. We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, QRner.ai shall not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the Platform, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability in connection with these Terms and your use of the Platform shall be limited to the amount you have paid to QRner.ai, if any, for the use of the Platform in the six (6) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless QRner.ai, its affiliates, officers, employees, agents, and licensors from any claims, damages, liabilities, losses, and expenses (including legal fees) arising out of your use of the Platform or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kuwait, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in Kuwait for any disputes arising out of or relating to these Terms or your use of the Platform.

15. Force Majeure

QRner.ai shall not be liable for any delay or failure in performance of the Platform due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, technical failures, or any other event or circumstance that is outside of our control.

16. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

  • Entire Agreement: These Terms constitute the entire agreement between you and QRner.ai regarding your use of the Platform, superseding any prior or contemporaneous agreements or understandings.

  • No Waiver: No waiver of any provision of these Terms shall be deemed a waiver of any other provision, nor shall a waiver of any breach be deemed a waiver of any subsequent breach.
